INSOURCING AND OUTSOURCING (TUPE)

If you are considering changing school status, changing service provision - either insourcing, or outsourcing - then you need to be aware that TUPE legislation may apply.

TUPE stands for The Transfer of Undertakings (Protection of Employment) Regulations 2006. The purpose of TUPE is to protect the employment rights, terms and conditions of service and continuous service of staff whose employer changes. In other words the new employer takes over the existing contracts of employment of staff transferred to them under the TUPE Regulations.

TUPE applies as a matter of law - it is not something employees or employers can decide to opt in or out of.
